Julie is filling in as Chairperson for Kate Hodge who is holidaying in France. Update on the family - Jason busy sewing for last couple of months, all done just need rain. Very dry season. Ron & Marg have headed off for big trip away. Julie is still busy working in education & having taken on a few extra shifts, lots of new staff & students. Lachlan has changed jobs & is now working in Shepparton, Alex is in his 3rd year as a diesel mechanic. Charlotte has started year 7 in Cobram.

Guest speaker – John Taylor, Director of Taylor & Whitty, Solicitors. John holds a Bachelor of Arts & Law degree. John has 30 years of experience in all aspects of law.

Born in Finley, son of a lawyer.

Discussion Wills & Powers of Attorney.

A Will is a document that only has effect after you die. You appoint executors to carry out your intent as defined in the will, together with Guardians & beneficiaries. Binding nominations are often referred to with superannuation & insurance companies and can override details in a will. Joint proprietors & tenants in common – different terms when purchasing property. Joint proprietors the interest automatically passes to the survivor, whereas tenants in common share the property.

If a will is challenged when one is defending a claim on an estate, the costs are generally awarded against the party that is unsuccessful in the claim.

Generally Executors are usually family members, whereas if State Trustees are appointed there are fees involved, often Executors think they should be paid to carry out their role to carry out the wishes of the testator.

By listing someone as a Power of Attorney you are primarily giving people power to make financial & personal decisions for you, whereas the appointment of a medical treatment decision maker you are appointing someone to make decisions regarding life support. It is a powerful document where you are giving power to someone to act as you, purchasing property etc. They can have a limiting effect or total effect in the event that you develop mental issues or physical issues, if there is no power of attorney people are required to apply for guardianship which can be expensive. The most bitter cases John has worked on are estates, where litigation chews up all the funds in an estate and can fragment families.

Secretary’s report – Phil Meagher -  Invitation from Nathalia Rotary Club for changeover dinner on 4/7/18 – 2 course dinner $25/head. Yea Garden Expo 22 & 23/9/18 10-4 at Saleyards. Application for summer science student which will go to Board.

Other reports – Ivan Routley & Alan Canobie – Golf club financed a banner for the art shower which was displayed. 12 members from our club went to Alby Barton’s funeral which captured Alby & expressed his homour.

Chris Sutton – Off to Toronto in a couple of weeks to the Convention & requires endorsement from the Club 5/6/18 she heads off & will have a bit of time with family whilst she is there. Home on 29/6/18 for district handover. Ride to Conference – Numurkah willing to have another team enter for a weekend ride which will need to be adopted as a club project for insurance purposes. Assistant District Govenor board meeting last weekend, highlights – financial reports presented, some discussion about District has a good surplus & therefore encouraging people to claim funds. Money from conference request from Moira Kelly’s charity, they need 2 water tanks to sufficiently protect their property $20,000 to come from funds. 1657 members in our district which is an increase. The Million dollar dinner in Euroa was cancelled because of low numbers, Ryla training had no management plan for critical incident in place when an attendee died earlier this year, but a plan has now been adopted for the future. Clubs need to list what they are planning on doing during the year, and inform District for insurance purposes. Next meeting is a combined district meeting again in Euroa in 2 weeks time.
